  2. Section 1: General Provisions Section 1.1. Short Title This ordinance shall be known as the "Roxwood County Municipal Code." Section 1.2. Purpose The purpose of this code is to ensure the well-being, safety, and orderly conduct of the citizens and visitors of Roxwood County. It seeks to establish fair, transparent, and uniform regulations for all aspects of daily life, promoting community harmony, safety, and the protection of public resources. Section 1.3. Definitions For the purposes of this Code, the following terms shall have the meanings ascribed to them: Person: Any individual, corporation, partnership, or other entity subject to the laws of Roxwood County. Vehicle: Any motorized vehicle, including cars, trucks, motorcycles, and other conveyances. Public Property: Any property owned by the county, including roads, parks, public buildings, and other government facilities. Section 2: Public Safety Section 2.1. Assault and Battery (a) A person commits assault when they intentionally inflict bodily injury on another person or cause fear of imminent bodily injury. (b) A person commits battery when they intentionally touch or strike another person without consent, causing harm. Section 2.2. Disorderly Conduct (a) It is unlawful for any person to engage in disorderly conduct in public, including but not limited to: Excessive noise. Fighting or disturbing the peace. Public intoxication. Section 2.3. Firearms and Weapons (a) It is unlawful for any person to carry or use firearms or dangerous weapons without the proper permits or licenses. (b) All firearms must be safely stored and carried in accordance with Roxwood County law. Section 3: Traffic Regulations Section 3.1. Speed Limits (a) The maximum speed limit within residential areas is 30 miles per hour. (b) The maximum speed limit on highways is 65 miles per hour unless otherwise posted. Section 3.2. Reckless Driving Any person operating a vehicle in a manner that endangers the safety of persons or property is guilty of reckless driving. Section 3.3. Driving Under the Influence (DUI) (a) No person shall operate a vehicle under the influence of alcohol, drugs, or any substance that impairs their ability to drive. (b) The legal BAC limit is 0.08%. Violators will face fines, suspension of driving privileges, and possible imprisonment. Section 4: Public Health and Safety Section 4.1. Littering and Waste Disposal (a) It is unlawful for any person to litter or improperly dispose of waste on public or private property. (b) Violators will be subject to fines and/or community service. Section 4.2. Smoking Restrictions (a) Smoking is prohibited in all enclosed public places, including government buildings, restaurants, and public transportation. (b) Smoking in designated smoking areas is permitted. Section 4.3. Noise Ordinance (a) It is prohibited to generate excessive noise that disturbs the peace, especially during the hours of 10:00 PM to 7:00 AM in residential areas. (b) The maximum allowable decibel levels will be defined and enforced by Roxwood County authorities. Section 5: Criminal Offenses Section 5.1. Kidnapping (a) Any person who unlawfully and intentionally seizes, confines, or carries away another person without their consent, for the purpose of extortion, ransom, or other illegal activities, shall be charged with kidnapping. (b) The penalty for kidnapping shall be determined based on the severity of the offense and the circumstances surrounding the crime. Section 5.2. Burglary (a) A person commits burglary when they unlawfully enter a building or structure with the intent to commit theft or any other felony therein. Section 5.3. Theft (a) Theft is the unlawful taking of property with the intent to permanently deprive the owner of its possession. (b) Theft can include stealing items from homes, businesses, or vehicles. Section 6: Code of Conduct Section 6.1. Public Decency (a) All persons must conduct themselves in a manner that does not disturb the peace, harm others, or endanger public safety. (b) Acts of indecency, such as public nudity, obscene language, or acts of violence, shall be punishable by law. Section 6.2. Vandalism (a) It is unlawful to damage, destroy, or deface public or private property. (b) Individuals caught vandalizing property shall face penalties, including fines, restitution, and possible jail time. Section 7: Emergency Situations Section 7.1. Emergency Vehicle Use (a) All drivers must yield the right-of-way to emergency vehicles when they are using their sirens and lights. (b) It is illegal to interfere with or obstruct the movement of emergency vehicles. Section 7.2. Disaster Preparedness (a) The county will establish emergency protocols in the event of natural or man-made disasters. (b) All citizens and visitors are encouraged to familiarize themselves with evacuation routes and emergency shelters. Section 8: Miscellaneous Provisions Section 8.1. Curfew (a) No minor under the age of 18 shall be on public property during the hours of 10:00 PM to 6:00 AM unless accompanied by a parent or guardian. Section 8.2. Business Hours (a) Businesses in Roxwood County are required to close no later than 2:00 AM unless they have a special permit for extended hours. Section 8.3. Alcohol Consumption (a) The consumption of alcohol is prohibited in public spaces such as parks and streets unless authorized by a permit. (b) The legal drinking age in Roxwood County is 21.

Definitions For the purposes of this Code, the following terms shall have the meanings ascribed to them: Person: Any individual, corporation, partnership, or other entity subject to the laws of Perico Island. Vehicle: Any off-road vehicle approved for rental on Perico Island. Public Property: Any property owned by the county, including roads, parks, public buildings, and other government facilities. Air-Travel: The only permitted mode of transportation for accessing Perico Island, excluding private vehicles and boats. Section 2: Public Safety Section 2.1. Assault and Battery (a) A person commits assault when they intentionally inflict bodily injury on another person or cause fear of imminent bodily injury. (b) A person commits battery when they intentionally touch or strike another person without consent, causing harm. Section 2.2. Disorderly Conduct (a) It is unlawful for any person to engage in disorderly conduct in public, including but not limited to: Excessive noise. Fighting or disturbing the peace. Public intoxication. Section 2.3. Firearms and Weapons (a) The use, carrying, or possession of firearms and dangerous weapons is strictly prohibited on Perico Island. (b) Violators will be subject to fines, confiscation of the weapon, and possible imprisonment. Section 3: Traffic Regulations Section 3.1. Restricted Access to the Island (a) Perico Island is only accessible by air travel. Private vehicles, boats, and other modes of transportation are prohibited from accessing the island. (b) Visitors must arrive via authorized air travel services only. Section 3.2. Off-Road Vehicle Restrictions (a) Only rental off-road vehicles, approved by the County of Perico Island, are permitted to operate on the island. (b) All vehicles must be rented from authorized vendors, and driving unauthorized vehicles is prohibited. (c) All off-road vehicles must adhere to safety standards set by the county. Section 3.3. Reckless Driving Any person operating an off-road vehicle in a manner that endangers the safety of persons or property is guilty of reckless driving. Section 4: Public Health and Safety Section 4.1. Littering and Waste Disposal (a) It is unlawful for any person to litter or improperly dispose of waste on public or private property. (b) Violators will be subject to fines and/or community service. Section 4.2. Smoking Restrictions (a) Smoking is prohibited in all enclosed public places, including government buildings, restaurants, and public transportation. (b) Smoking in designated smoking areas is permitted. Section 4.3. Hunting and Firearm Discharge Prohibition (a) Hunting is strictly prohibited on Perico Island. (b) The discharge of firearms is also prohibited on the island, including in private areas or recreational zones. (c) Violators will face fines, and any firearms found in violation of this ordinance will be confiscated. Section 5: Criminal Offenses Section 5.1. Kidnapping (a) Any person who unlawfully and intentionally seizes, confines, or carries away another person without their consent, for the purpose of extortion, ransom, or other illegal activities, shall be charged with kidnapping. Business Hours (a) Businesses in Perico Island are required to close no later than 1:00 AM unless they have a special permit for extended hours. Section 8.3. Noise Ordinance (a) It is prohibited to generate noise that exceeds acceptable decibel levels in residential areas between the hours of 10:00 PM and 7:00 AM. (b) The acceptable noise limit will be defined by the County authorities and may vary by area.

Vehicle: Any motorized or self-propelled device used for transportation, including cars, trucks, motorcycles, and other conveyances. Public Property: Any property owned by the county or state, including roads, parks, and government buildings. Section 2: Public Safety Section 2.1. Assault and Battery (a) A person commits assault when they intentionally inflict bodily injury on another person or cause fear of imminent bodily injury. (b) A person commits battery when they intentionally touch or strike another person without consent, causing harm. Section 2.2. Disorderly Conduct (a) It shall be unlawful for any person to engage in disorderly conduct in public, including but not limited to: Excessive noise. Fighting or disturbing the peace. Driving Under the Influence (DUI) (a) No person shall operate a vehicle under the influence of alcohol, drugs, or any substance that impairs their ability to drive. (b) The legal BAC limit is 0.08%. Failure to Obey Traffic Signal or Control Device The act of failing to obey a road traffic signal or traffic control device, issued, controlled, or placed on or near a roadway for the use of directing traffic. This offense is considered an infraction and is punishable by up to $600. Proceeding Through a Red Light The act of making a maneuver such as proceeding through a red light. This offense is considered an infraction and is punishable by up to $600. Failing to Stop at Amber Signal The act of making a maneuver such as failing to stop at an amber signal when safe to do so. This offense is considered an infraction and is punishable by up to $600. Failure to Stop at Stop Sign or Indicator The act of failing to stop at a stop sign, stop indicator, or slow indicator given by a traffic controller. This offense is considered an infraction and is punishable by up to $600.
  7. Making an Illegal U-Turn The act of making a u-turn where it is posted to be illegal to do so. This offense is considered an infraction and is punishable by up to $600. Illegal Passing The act of passing another motor vehicle when posted to be illegal to do so or crossing double yellow lines. This offense is considered an infraction and is punishable by up to $600. Failure to Stay Within Lane Failure to stay within one's lane by crossing over or touching the designated lines. This offense is considered an infraction and is punishable by up to $600. Improper Lane Change The act of switching one’s lane improperly, such as, but not limited to, failure to check blind spots, driving aggressively, cutting in front of a vehicle, or any other negligent act. This offense is considered an infraction and is punishable by up to $600. Improper Turning Failure to turn in a safe and marked manner, such as, but not limited to, turning on red when it’s posted not to, making a u-turn when it’s posted not to, or any other abrupt turns without signalling. This offense is considered an infraction and is punishable by up to $600.
  8. First Degree Speeding Operating a motor vehicle at one (1) mph or more over the speed limit but not exceeding 15 mph over the speed limit. This offense is considered an infraction and is punishable by up to $600. Second Degree Speeding Operating a motor vehicle at fifteen (15) miles per hour over the speed limit but not exceeding twenty-five (25) miles per hour over the speed limit. This offense is considered an infraction and is punishable by up to $1,000. Third Degree Speeding Operating a motor vehicle twenty-six (26) miles per hour over the speed limit or; Operating a motor vehicle over one-hundred (100) miles per hour on the roadway. This offense is considered a felony and is punishable by up to $5,000 and 60 Months imprisonment.
  9. Failing to yield to a vehicle that has the right of way. Failing to yield to an emergency vehicle responding with lights and an audible signal. This offense is considered an infraction and is punishable by up to $600.
  10. The act of wilfully and intentionally driving an unroadworthy vehicle upon a public roadway. A vehicle must be equipped with the following to be declared roadworthy: At least two (2) functional headlights. At least two (2) functional brake lights. Functional reverse lights. Functional hazard lights. Functional front and rear demisters. Front, rear, and side windows. Functional horn. No fuel or oil leaks. Seatbelts. Mirrors. Pedals. Windshield wipers. Dash lights. Working suspension. A vehicle may not possess the following: Headlights of any color other than white or xenon. Underglow of any color. Body kits that emit any colors from the vehicle. Flashing lights of any kind unless the driver possesses a traffic control certification. Window tint with less than 70% visible light transmission. Nitrous Oxide. This offense is considered an infraction and is punishable by up to $600 and impoundment.
  11. The state of having, owning, or controlling ecstasy-related units on one's person or property. The state of having, owning, or controlling more than 50 units of ecstasy-related substances with the intent to distribute or sell. The state of having, owning, or controlling heroin. The state of having, owning, or controlling more than 50 units of heroin. The state of having, owning, or controlling more than 5 units of Adderall. The state of having, owning, or controlling more than 50 units of Adderall. The state of having, owning, or controlling more than 5 units of Xanax. The state of having, owning, or controlling more than 50 units of Xanax. This offense is considered a felony and is punishable by up to $5,000 and 60 months imprisonment.
  12. The willful act of possessing or owning cocaine or cocaine base [crack] in any amount. The willful act of being intoxicated by cocaine. The willful act of having any amount of the substance remain on one's property. The state of having, owning, or controlling methamphetamine-related units on one's person or property. The state of having, owning, or controlling units of methamphetamine on one's person or property. The state of having, owning, or controlling more than 50 units of oxycodone and/or hydrocodone/acetaminophen. This offense is considered a felony and is punishable by up to $5,000 and 60 months imprisonment.
  13. The state of being intoxicated, owning, or possessing marijuana beyond the legal limit of one (1) ounce. The possession of marijuana seeds or property containing a marijuana farm. The act of growing marijuana without a permit. This offense is considered a misdemeanor and is punishable by up to $5,000 and 60 months imprisonment.
  14. Conduct that is wrongful and reckless or wanton, and likely to produce death or grievous bodily harm to the general public. Conduct that is wrongful and careless or wanton, and likely to produce bodily harm to another individual. Conduct that is wrongful and careless or wanton, and likely to produce great bodily harm or death to another individual. This offense is considered a felony and is punishable by up to $5,000 and 60 months imprisonment.
  15. The crime of willingly and intentionally possessing a firearm without a state-issued firearms license. Possession of a firearm with a suspended or revoked firearms license. This offense is considered a misdemeanor and is punishable by up to $5,000 and 60 months imprisonment.
  16. The state of having, owning, or controlling melee weapons and firearms such as standard rifles while under felony status with intent to distribute or sell. The state of having, owning, or controlling firearms such as semi-automatic and automatic weapons with the intent to distribute or sell without having a court-approved license to sell and possess. The state of having, owning, or controlling firearms such as explosive ordnances with the intent to sell. This offense is considered a felony and is punishable by up to $5,000 and 60 months imprisonment.
  17. The act of possessing a melee weapon, stun device, ammunition, or firearms such as pistols and hunting rifles while being a convicted felon under San Andreas Law. The act of possessing, owning, or controlling a firearm such as an automatic weapon or automatic ammunition. The act of possessing, owning, or controlling an explosive ordnance device. This offense is considered a felony and is punishable by up to $5,000 and 60 months imprisonment.
  18. Evading Law Enforcement: The act of intentionally and willingly avoiding law enforcement, arrest, or the legal consequences of their actions. The act of intentionally using their vehicle to escape from law enforcement custody, detainment, arrest, or the legal consequences of their actions. This offense is considered a felony and is punishable by up to $5,000 and 60 months imprisonment.
  19. Destruction of Private Property: The act of destroying property with a result of less than $10,000. The act of destroying property with a result of more than $10,000. The act of willingly destroying or tampering with government property. The act of willingly destroying, tampering, or tampering with a government-assigned tracking device. The offense of Destruction of Private Property is considered a felony and is punishable by up to $5,000 and 60 months imprisonment.
  20. Resisting Arrest: Preventing or hindering a lawful arrest, detainment, or otherwise disobeying a lawful order to surrender if probable cause for the officer exists is a violation of the law. The offense of Resisting Arrest is considered a misdemeanor and is punishable by up to $5,000 and 60 months imprisonment.
  21. Failure to Identify: When requested by a member of law enforcement during a traffic stop, Terry stop, or other legal investigation tying you directly into the investigation, a member of the public is required to identify upon request of the officer. A member is not required to identify to a police officer if they have been illegally stopped without probable cause. The offense of Failure to Identify is considered a misdemeanor and is punishable by up to $5,000 and 60 months imprisonment.
  22. Obstruction of Justice: An act of obstructing an officer from carrying out an investigation by hindrance, annoyance, or otherwise entering, or disobeying a direct order from a law enforcement officer during an official investigation. Interfering or distracting an officer from conducting their lawful duties during an investigation.
